FA2 Doubles Assumption of Risk, Waiver of Liability, and Indemnification Agreement
Enrollment in any services offered by FA2 constitutes acceptance of all terms stated in this agreement.
1. General Policies

For Tennis Camp enrollment, we do NOT offer makeups, credits, or refunds for any missed dates, no-shows, or prorate for advanced notice of absences. Please be sure of your schedule.

For non-Full Season class & private lesson enrollments (i.e., single classes/lessons, 10-packs), cancellation of scheduled classes is allowed up to 24 HOURS before the class for a store credit. No-shows and/or failure to notify will forfeit any eligible credit.

Proper on-court etiquette is expected by all patrons of LA Tennis Centers & LA City Parks. We reserve the right to refuse service.

There are NO REFUNDS.
2. Assumption of Risk, Waiver of Liability, and Indemnification
FA2Tennis (hereafter referred to as FA2) is a tennis-related business whose goals are:

To provide youth and adults the opportunity to learn and/or improve their tennis skills.

To provide wholesome recreational opportunities through recreational and competitive tennis play.
FA2 provides private and group lessons for adults as well as adult clinics called “Live Ball” (a dynamic, non-stop tennis doubles activity). Youth can sign up for private lessons or group clinics (divided into three categories based on skill level).
Additionally, FA2 offers summer tennis camps for minor participants.
This agreement applies to:

Personal injury (including death) from incidents or illnesses arising from participation (or that of a minor participant) in FA2 Activities (including instruction, individual or group activity, competitions, training, practice, classes, special events, camps, observation, use of facilities or equipment, and all premises including sidewalks and parking lots).

Any claims resulting from damage to, loss of, or theft of property.
The above are collectively referred to herein as FA2 Activities. In exchange for the opportunity to participate in FA2 Activities and/or enter FA2 premises, I (hereafter “PARTICIPANT”) agree to all of the following:
3. Things You Need to Know
FA2 Activities provide many benefits, including: enjoyable recreation, improved fitness, increased confidence, better weight control, and skill development. However, FA2 Activities involve vigorous physical activity, including but not limited to: jumping, landing, running, swinging a racket, following and striking fast-moving balls, and other skills. Participation includes inherent risks of injury that cannot be eliminated.
Examples of Risks:
Activity Risks: slips, trips, awkward landings, collisions with participants or objects, being struck by a ball or racket, stepping on balls, equipment failure, over-exertion.
Environmental Risks: extreme temperatures, sudden weather changes, high winds, wet or slick courts, lightning.
Participant-related Risks: erratic co-participant behavior, carelessness, judgment errors.
Leadership-related Risks: supervisory or judgment errors, such as misjudging participant capacity or skill, failure to spot hazards, momentary distraction.
FA2 recognizes three categories of injuries:

Minor: scratches, bruises, cuts, muscle pulls, soreness, sprains.

Major: injuries to eyes, joints, feet, legs, hands, arms, chest, back, teeth, neck, or head (including concussions).

Catastrophic: permanent disability, paralysis, heart attack, or death.
4. Assumption of Inherent Risks
I, the PARTICIPANT/PARENT, acknowledge that FA2 Activities carry significant inherent risks which vary with the activity. I understand the demands of the activities relative to my physical condition and skill level (or that of my minor participant) and voluntarily assume all risks, including those caused by any negligence of FA2.
5. Waiver of Liability for Ordinary Negligence
In consideration of permission to participate in FA2 Activities, I, the PARTICIPANT/PARENT, on behalf of myself, my spouse, heirs, personal representatives, and assigns (hereafter “Releasing Parties”), release, waive, discharge, and covenant not to sue FA2, its owners, directors, officers, instructors, employees, volunteers, co-participants, independent contractors, equipment providers, agents, and owners of facilities (City of Los Angeles) utilized for FA2 Activities (hereafter “Protected Parties”) from liability arising from ordinary negligence.
6. Indemnification Agreement
I, the PARTICIPANT/PARENT, agree to defend, indemnify, and hold harmless FA2 and Protected Parties against all claims arising from participation in FA2 Activities, including claims resulting from inherent risks or ordinary negligence, as well as claims from co-participants, rescuers, or others on the premises.
7. Clarifying Clauses

This agreement supersedes any prior oral or written agreements and represents the entire agreement between myself and FA2.

This agreement may not be amended by statements of FA2 employees.

If any portion is held invalid, the remaining provisions remain in full force.

Legal actions shall be brought exclusively in Los Angeles County, California, or the Central District of California, under California law.
8. Participant Agreements, Acknowledgements, and Assertions
Health:
-
Participants should obtain medical clearance before participation.

Participants must notify staff of health issues that may make participation unwise.

FA2 is authorized to secure emergency medical care or transport, with participants assuming all costs.
Safety:
-
Participants must avoid activities they feel are too risky and report unsafe conditions.
Injury Reporting:

All injuries must be reported to FA2 before leaving the facility.
Conduct:
-
Participants must follow all FA2 policies and rules. FA2 may terminate participation if actions are harmful.
Photo/Video Release:
-
Participants authorize use of images/videos for marketing and promotional purposes.
9. Acknowledgement of Understanding
Enrollment in any services offered by FA2 constitutes acceptance of all terms stated in this agreement.
I, the Adult PARTICIPANT or Parent/Legal Guardian of the minor child participating in FA2 Activities, have read this agreement and understand that I am giving up substantial rights, including the right to sue for damages in the event of death, injury, or loss. I agree to be bound by this agreement on behalf of myself, my spouse, the minor child, and any other party filing on behalf of the minor child.
I acknowledge that I am voluntarily signing this agreement and intend my signature to constitute a complete release of all liability, including that due to inherent risks or ordinary negligence of Protected Parties, to the greatest extent permitted by California law. By signing for a minor, I confirm the minor has been informed of these risks and understands this agreement.
